What changed: Effective October 9, 2026, ATF will no longer require individuals to seek ATF approval before making or transferring short-barreled rifles, short-barreled shotguns, silencers, and "any other weapons" ATF will also no longer enforce NFA registration, tax-stamp, or related requirements for those covered items The nonenforcement applies uniformly to everyone — not just the plaintiffs in the Silencer Shop Foundation v. ATF litigation What stays the same: The $200 tax remains in place for machine guns and destructive devices State and local laws restricting NFA firearms are not superseded Interstate transportation of SBRs and SBSs still requires ATF approval via Form 20 under the Gun Control Act Licensed dealers must still complete Form 4473s, run NICS background checks, and follow all other GCA requirements This follows an August 5 ruling by a U.S. district judge in the Northern District of Texas, which held that the remaining registration scheme for these items was unconstitutional after Congress eliminated the tax.
